Terms of Use

These Terms of Service (“Terms”) govern your access to and use of LocalBizUS.com (“LocalBizUS,” “we,” “us,” or “our”) and related services including submitting, claiming, and managing business listings, reviews, and memberships (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Provide accurate, current information and promptly update it as needed.
• U.S. businesses only. LocalBizUS accepts listings only for U.S.-based businesses. A valid U.S. city and state are required for every listing. A street address is required for storefront listings and optional for service-area and mobile / by-appointment businesses (for example, home-based providers, food trucks, and businesses that travel to the customer). Submissions that do not meet these eligibility requirements may be rejected at submission or removed after the fact, at our discretion and without notice.
• Location types & privacy. When you choose service-area or mobile / by-appointment, any street address you provide is stored for our internal records only and is not displayed publicly on your listing. Your public listing will instead show your service area (city and state). You are responsible for choosing the location type that accurately reflects how your business operates.
• Ongoing accuracy. After a listing is approved and published, the business owner or listing contact is responsible for logging in to review and maintain the accuracy of their listing information, including business details, contact information, and images. LocalBizUS is not responsible for incorrect or outdated information published in a listing.

• You retain ownership of content you submit (e.g., listings, text, images) but grant LocalBizUS a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it for operating and promoting the Services.
• You represent you have all rights necessary to submit the content and that it does not infringe others’ rights or applicable laws.
• We may moderate or remove content at our discretion (e.g., spam, illegal, offensive, misleading, or policy-violating content).
• Public content (e.g., approved listings, reviews, business info) may be visible on the site and in search results.

• Authorization. You may submit a listing for your own business, or for another business only if you are authorized to act on that business’s behalf (for example, as an SEO provider, marketing agency, or consultant). Any agency, marketer, contractor, or other third party that submits or manages a listing represents and warrants that it has the business’s permission to create and maintain the listing, and that the business has agreed to be bound by these Terms of Use.
• Responsibility for content. The business and/or its authorized agent (including any SEO or marketing agency) is solely responsible for the accuracy, legality, and truthfulness of all listing content, claims, images, links, contact details, and related materials. LocalBizUS does not guarantee or endorse any listing and is not responsible for errors or omissions in listings.
• Platform only; not your agent. LocalBizUS acts only as a directory and marketing platform. We are not an agent, partner, or representative of any business or agency that uses the platform, and we are not a party to any contract or transaction between businesses, agencies, and customers.
• Contacting listed businesses. LocalBizUS may contact a listed business directly for verification, support, compliance, dispute resolution, and to offer LocalBizUS services, upgrades, or promotional opportunities, even if the listing was submitted or managed by an agency or other third party. For this purpose, LocalBizUS may collect and maintain internal business contact information that is not displayed publicly. Agencies, marketers, contractors, and other third parties that submit or manage a listing understand and agree that LocalBizUS may communicate directly with the underlying business, including their clients, regardless of who submitted the listing.
• Right to edit, suspend, or transfer listings. We reserve the right to edit, suspend, reject, remove, or transfer control of a listing if authorization is disputed; if a listing appears misleading, spammy, or primarily for SEO or backlink purposes; or if it violates these Terms or applicable law. A business may request review or ownership of a listing that was submitted by an agency, subject to verification. Disputes about unauthorized or inaccurate listings may be sent to admin@localbizus.com.

• LocalBizUS currently offers a free Basic listing and a paid Premium Listing at $99.00 USD per year, billed annually in advance. Prices and features may change with prior notice as required by law.
• Payments are processed by Stripe. We do not store full card numbers. Sales tax, where applicable, is calculated, collected, and remitted by Stripe on our behalf.
• Auto-renewal: Premium subscriptions automatically renew each year on the anniversary of purchase using the payment method on file until you cancel. We send reminder emails approximately 30 days and 7 days before each renewal.
• Cancellation: You can cancel any time from the Billing page in your account (Stripe Customer Portal). Cancellation stops future renewals; your Premium features and benefits remain fully active through the end of the paid period. When the period ends, the listing automatically reverts to a Basic listing — no further charges occur.
• Data retention after lapse: When a Premium subscription lapses or is canceled, we retain all of your Premium content (image gallery, video, coupon, social links, custom CTA, map data, etc.) on your listing. Premium-only features are simply hidden from public view while the listing is Basic, and are automatically restored if you resubscribe. You may also receive occasional reminder emails inviting you to renew.
• Failed payments: If a renewal payment fails, we will email you and Stripe will retry the charge. If the subscription remains unpaid, Premium features will be hidden and the listing will revert to Basic until payment is resolved; your Premium content is retained as described above.
• Refunds: Except where required by law, fees are non-refundable once a billing period has begun. We do not pro-rate partial periods.
• Deleting a Premium listing: Deleting a listing that has an active Premium subscription will not automatically cancel billing. Please cancel the subscription from the Billing page before deleting the listing, or contact us for assistance.
• Complimentary Premium: LocalBizUS may, at its sole discretion, grant complimentary Premium for a limited period. Complimentary Premium has no charge, no card on file, and no auto-renewal, and may be revoked at any time.
• Records: Invoices and receipts are available in the Stripe Customer Portal from the Billing page.

• No unlawful, fraudulent, defamatory, hateful, harassing, or otherwise harmful activity.
• No spam, scraping, reverse engineering, or interference with the site’s normal operation.
• No posting of others’ personal data without permission or legal basis.
• No intellectual-property infringement or deceptive business claims.

The Services, including the LocalBizUS name, logo, and site design, are protected by intellectual-property laws. Except for your content and permitted uses under these Terms, you may not copy, distribute, or create derivative works without our written permission.

If you believe content infringes your copyright, send a notice with sufficient detail (work claimed infringed, location of the material, your contact info, and a sworn statement of good faith and accuracy) to admin@localbizus.com. We may remove content and, where appropriate, terminate repeat infringers.

We may link to or integrate third-party services (e.g., maps, analytics, payments). Their terms and privacy policies govern your use of those services. We are not responsible for third-party content or practices.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation or the accuracy of listings or user content.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCALBIZUS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 6 MONTHS BEFORE THE CLAIM OR (B) $100.

You agree to defend, indemnify, and hold harmless LocalBizUS and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms or applicable law.

We may suspend or terminate access at any time for any reason, including policy violations or legal risk. Upon termination, your right to use the Services ceases, but certain provisions (e.g., IP, disclaimers, limitations of liability, indemnification) survive.

These Terms are governed by the laws of the State of Arizona and the United States, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of state or federal courts located in Maricopa County, Arizona, for disputes not subject to informal resolution. You and we agree to first attempt good-faith resolution before filing suit.

We may update these Terms periodically. Continued use after changes become effective constitutes acceptance of the updated Terms.
